Terms of Service
These Terms of Service ("Terms") govern your use of Munch, operated by the Munch team ("Munch," "we," "us"). By creating an account or using Munch, you agree to these Terms. If you do not agree, do not use Munch.
1. Eligibility
You must be at least 18 years old to use Munch. There are no exceptions. By creating an account you confirm that you are 18 or older, that you have not been convicted of a felony, a sex crime, or a crime involving violence, and that you are legally able to enter into these Terms. You may hold only one account, under your own real identity.
2. Your account
You are responsible for keeping your account information accurate, your password secure, and your account activity within these Terms. Do not share your account, create a second account, or impersonate anyone. We may ask you to complete identity verification (such as a selfie check) to confirm you are a real adult; this helps keep the community genuine and safe. Report unauthorized access to your account to support@munchkink.app immediately.
3. What Munch is
Munch is a kink and BDSM dating and community app for open-minded adults. It is not a pornography service, an escort platform, or a place to buy or sell sexual services, and it is not a "sugar" or compensated-dating app.
4. Acceptable use
You agree not to:
- Post nudity, pornography, or sexually explicit media.
- Harass, threaten, stalk, or abuse other people.
- Share someone's intimate images without their consent.
- Solicit or offer commercial sexual services, escort services, or compensated ("sugar") arrangements.
- Depict, describe, or solicit non-consensual acts, or misrepresent coercion or abuse as a consensual dynamic.
- Post content that sexualizes or endangers minors in any way (see our Child Safety Standards) — we enforce this without exception.
- Impersonate another person, spam, phish, run scams, or solicit money from other members.
- Scrape the service or access it through automated means.
- Break any applicable law.
We may remove content and suspend or terminate accounts that violate these Terms, with or without notice.
5. Moderation and reporting
Every profile, photo, post, and message can be reported through the in-app report tools. We aim to review reports promptly, and reports involving child safety or immediate danger are prioritized. Suspected child sexual abuse material is escalated to the National Center for Missing & Exploited Children (NCMEC) — see Child Safety Standards below for how to report it correctly.
6. Child Safety Standards
Munch is a dating and community service for adults 18 and over. Minors are not permitted on the service under any circumstance. We have zero tolerance for child sexual abuse and exploitation (CSAE). This section is also published on its own at Child Safety Standards.
Prohibited content and conduct
The following are strictly prohibited on Munch, without exception:
- Creating, sharing, or requesting child sexual abuse material (CSAM).
- Sexualizing minors in any form, including text, images, or role-play.
- Grooming, sextortion, or any attempt to solicit a minor.
- Child trafficking or facilitating access to a minor for any purpose.
- Underage account creation or use of Munch by anyone under 18.
- Directing other users to CSAE material hosted off-platform.
How we keep minors off Munch
- Age gate: every account must confirm a date of birth at sign-up.
- Identity verification: we may require a selfie or ID check to confirm an account belongs to a real adult.
- 18+ store rating: Munch is listed as an adults-only app on the app stores that distribute it.
- Automated and human review: we use a combination of automated detection and human moderation to find and remove accounts that appear to belong to minors.
Content detection
Images uploaded to Munch are scanned using industry-standard hash-matching technology (such as PhotoDNA) against known CSAM hash sets, including those maintained by the National Center for Missing & Exploited Children (NCMEC). Matches are removed and reported.
How to report
If you encounter content or behavior that sexualizes, exploits, or endangers a minor, report it immediately:
- Use the in-app Report option on any profile, photo, or message.
- Email childsafety@munchkink.app for general child-safety concerns.
Do not email suspected CSAM directly to us or to anyone else. Report it through the in-app report tool so it can be handled and escalated safely. We review child-safety reports as a priority.
Law enforcement cooperation
Where required by law, we report confirmed CSAM to the NCMEC CyberTipline and cooperate with lawful requests from law enforcement.
Enforcement
These standards apply to every user and all content on Munch. We enforce them through age restriction, identity verification, automated and human moderation, in-app reporting, permanent account removal, and reporting to the appropriate authorities. Accounts that violate these standards are permanently banned, and we take steps to prevent banned individuals from creating new accounts.
7. Content you post
You keep ownership of the content you post. You grant Munch a worldwide, non-exclusive, royalty-free license to host, store, and display that content solely to operate and improve the service. You are responsible for what you post and confirm you have the right to post it.
8. Meeting people safely
Munch is a place to meet people online and, when you choose, in person — including at local munches and community events. Use good judgment: meet in public for a first in-person meeting, tell someone you trust where you're going, and treat consent as an ongoing conversation, not a one-time yes. We do not conduct criminal background checks on members; you are responsible for your own interactions and safety.
9. Subscriptions
Some features may require a paid subscription. Subscriptions are billed through the app store account you used to download Munch (Google Play or the Apple App Store) and renew automatically unless cancelled. Cancel at least 24 hours before renewal in your app store account settings, or the subscription will keep renewing. Payments are non-refundable except where required by law or by the app store's own refund policy.
10. Termination
You can delete your account at any time — see Delete Your Account. We may suspend or permanently ban accounts that seriously or repeatedly violate these Terms or the law, and we may block the creation of new accounts by someone whose account was banned.
11. Disclaimers and limitation of liability
Munch is provided "as is," without warranties of any kind. To the maximum extent permitted by law, our total liability arising from your use of Munch will not exceed the greater of the amount you paid us in the twelve months before the claim, or USD 100.
12. Disputes and governing law
If you have a dispute with us, contact legal@munchkink.app first. We ask for a 30-day informal resolution period before either side files a claim. These Terms are governed by the laws applicable in our place of business, without regard to conflict-of-laws rules.
13. Changes
We may update these Terms. We will post the new version here with an updated date. Continued use after changes means you accept them.
